5. Convention/Clinic Displays - June 2005

Question 1
The ARMM is a pharmaceutical representatives association in the Mauricie area. We need your expertise with the following:

• CHRDL (Joliette Hospital) Exhibits

In the past, Exhibits were held in the physician's locker room. Last year, the CHRDL's Management moved us from the locker room to the hall next to the locker room and the cafeteria, in front of the elevators. As you can imagine, it is not very appropriate to hold private discussions with the doctors in such a busy area of the Hospital with patients walking around and all the activities surrounding this area. The ARMM's Executive Committee tried to resolve the problem with the CMDP & DSP directors by making them aware of our ethic problems and our reality. They offered us to move the table exhibit in the future locker room in the quietest area of the Administrative Department. The new problem is they want us to contribute in the «Up to Date» institution Web site. Is this within Rx&D Guidelines?

Response:
This would contravene section 8.2.7 of the Code, which states that under no circumstances may company representatives pay a fee to gain access to health care professionals.
