13. Advisory

Question 1:
This question applies to Section 13.8 of the Code where it states
"An advisory board / consultant's panel may be organized
by International affiliate. These meetings if held outside
of Canada may include a maximum of 10 Canadian HCPs, per brand,
per year (experts in the field)...". Can an "expert
in the field" attend more than one Advisory Board meeting
organized by an International affiliate (held outside of Canada)?
Response:
Yes. This matter is clear in the cases whereby advisory
boards are held for different brands. Subject to the provisions
of Sections 1 and 13, the choice of HCP participants on advisory
boards is up to the discretion of each member company as an
internal business matter.
In regard to multiple advisory board meetings organized by
an International affiliate that are held for the same brand
during the same year, the HCP participant can attend those
meetings and will be considered as a single member of the
maximum of 10 participants for that advisory board.
However, International affiliates of member companies should
be guided by Section 13.4's provisions for advisory
board meetings: they must be both limited in number and “consistent
with the need to gather scientific input or commercial guidance.”
Section 1 of the Code continues to be of particular relevance.
