Re: April Section 12-Q2
Based on the principle of "No monetary or other consideration
is to be given to HCPs for the purpose of gaining access or
influence", I would like to ask two follow-up questions
related to the second part of the answer. The questions are:
1. Can the contracted Market Research Company conduct the
research at a separate booth?
2. Can the market research be conducted at our company booth
without providing any incentive (in cash or in kind) to the
participants?
Response:
1. It is clear from numerous examples that the Code applies
equally to the activities of Rx&D Members and the companies
that act on their behalf. Thus, the Code is still in effect
whether or not an independent market research company is conducting
the program.
With this understanding, members should consider carefully
the ramifications of a contracted market research company
setting up a separate booth at an event, especially if the
contracted market research company offered incentives to the
participants.
2. Yes, as there is no perception that the member is paying
to have access to HCPs.
It is important to keep in mind that market research activities
by Members or their agents are conducted in accordance with
Section 12. (Market Research) of the Code of Conduct.
